In the questions below, “Task Force” refers to the “Envision San Jose 2040 General Plan Review Task Force“.
- Did the Task Force authorize Opportunity Housing citywide on 8/20/20? No. The Task Force simply recommended that the City Council decide to have City staff explore Opportunity Housing citywide. The exploration includes community outreach. Criteria and restrictions would need to be developed and approved by the City Council.
- What exactly did the Task Force recommend? Read the full text of the Task Force recommendation.
- What about rules on setbacks, rules on trees, rules on heights, etc.? No changes to those rules have been proposed. Criteria and restrictions would need to be developed by City staff and approved by the City Council after community outreach and input.
- Does the Task Force’s recommendation address the need for Opportunity Housing to be compatible with, and blend in, with existing neighborhoods? The Task Force’s recommendation is that the following be initiated: “Update the Citywide Design Guidelines and Standards to include Opportunity Housing design standards that ensure that Opportunity Housing projects are designed to be compatible with existing neighborhoods.
Revise the General Plan and Zoning Code to allow and facilitate Opportunity Housing while maintaining the intent for Opportunity Housing to blend in with the existing neighborhood.”
- What does someone mean when they say that Opportunity Housing will change the “character” of a neighborhood? It is unclear since the online petition opposing Opportunity Housing does not elaborate.
- Is it true that Opportunity Housing would allow any single-family property owner to build up to seven units on their property and/or a building many stories high? Exactly who would be allowed to redevelop their property and what they could redevelop into has not been identified, so those making this claim are mistaken. Criteria and restrictions would need to be developed and approved by the City Council after community outreach and input.
- Is it true that a developer could buy your property and convert it to up to seven units? The Task Force simply recommended that the City Council decide to have City staff explore Opportunity Housing citywide. The exploration includes community outreach and input. Criteria and restrictions would need to be developed and approved by the City Council.
- Is the Task Force supposed to suggest revisions to the existing General Plan? The City Council directed the Task Force to consider certain items. The purpose is to determine what revisions are necessary to the General Plan. The task force must consider those items and potential changes to the General Plan. In other words, the Task Force is supposed to identify and recommend revisions. Opportunity housing was one item. The Task Force was performing its role in considering Opportunity Housing and in making a recommendation. If someone says the role of the Task Force is to try to enforce the most recent version of the General Plan, that person is mistaken.
